TERMS OF SERVICE

Fashion Femina Garments

These Terms of Service (“Terms”) govern your access to and use of the website, social-media ordering channels, messaging platforms, online stores, and other sales channels operated by Fashion Femina Garments (“Fashion Femina Garments,” “we,” “us,” or “our”), and your purchase of any products or services offered by us.

By visiting our website, communicating with us regarding an order, requesting a quotation, placing an order, making payment, approving a design or customization, or otherwise purchasing products from us, you (“Customer,” “you,” or “your”) acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, you should not place an order with us.

These Terms constitute an agreement between Fashion Femina Garments and the Customer and should be read together with any quotation, invoice, order confirmation, measurement form, customization approval, payment receipt, or other written communication issued by us in relation to an order.


1. ABOUT OUR PRODUCTS

1.1 Product Category

Fashion Femina Garments specializes in ladies’ ethnic and occasion wear, including, without limitation:

  • Suits and salwar suits

  • Punjabi suits

  • Anarkali suits

  • Sarees

  • Lehengas

  • Dresses

  • Kurtis

  • Bridal and party wear

  • Embroidered garments

  • Customized garments

  • Made-to-measure garments

  • Other ethnic or fashion garments offered from time to time

1.2 Ready-to-Wear, Made-to-Order and Custom Products

Products may be offered as:

a. ready-to-wear products;
b. made-to-order products;
c. custom-sized products;
d. customized products; or
e. products incorporating Customer-selected fabrics, colors, embellishments, measurements, designs, patterns, specifications, or other instructions.

The applicable product description, quotation, invoice, or order confirmation will determine the nature and specifications of the particular order.

1.3 Handmade and Artisan Characteristics

Many of our garments involve handwork, embroidery, tailoring, embellishment, stitching, dyeing, finishing, or other artisanal processes.

Accordingly, minor variations may occur between product photographs, samples, previous orders, and the finished garment. Such variations may include, without limitation:

  • slight differences in color or shade;

  • embroidery placement;

  • print placement;

  • fabric texture;

  • thread arrangement;

  • embellishment positioning;

  • stitching;

  • finishing;

  • measurements within reasonable manufacturing tolerances; and

  • other characteristics resulting from the manufacturing or artisanal process.

Such reasonable variations shall not, by themselves, constitute a defect or failure to perform.

1.4 Product Images and Colors

We make reasonable efforts to display product colors, textures, embroidery, and details accurately. However, actual colors may vary depending on:

  • your device;

  • screen settings;

  • lighting conditions;

  • photography;

  • fabric batches; and

  • manufacturing or dyeing processes.

A minor visual difference between an image displayed online and the physical product does not automatically constitute a defect.


2. CUSTOMIZATION AND CUSTOMER APPROVAL

2.1 Customer Specifications

Where an order involves customization, the Customer is responsible for carefully reviewing and confirming all specifications supplied to Fashion Femina Garments.

These may include:

  • measurements;

  • size;

  • length;

  • sleeve specifications;

  • neckline;

  • garment style;

  • color;

  • fabric;

  • embroidery;

  • embellishments;

  • design;

  • stitching instructions;

  • finishing instructions;

  • shipping address; and

  • other customization requirements.

2.2 Customer Approval

Where we provide sketches, photographs, references, mock-ups, descriptions, measurements, customization summaries, or other details for Customer approval, the Customer is responsible for reviewing those details before giving approval.

Once the Customer approves the specifications, production may proceed based on that approval.

2.3 Changes After Approval

Any request to change an order after production, cutting, embroidery, stitching, sourcing, procurement, or other work has commenced may be declined.

If we agree to accommodate a change, additional charges, production time, shipping costs, material costs, or alteration charges may apply.

The Customer has no automatic right to require changes after production has commenced.


3. MEASUREMENTS AND CUSTOMER-PROVIDED INFORMATION

3.1 Accuracy of Measurements

For custom or made-to-measure garments, the Customer is solely responsible for providing accurate and complete measurements and instructions.

We may provide measurement guidance where available; however, such guidance does not transfer responsibility for the accuracy of measurements to Fashion Femina Garments.

3.2 Incorrect Measurements

If a garment is produced according to measurements, sizes, or specifications supplied or approved by the Customer, any resulting fitting issue caused by inaccurate or incomplete Customer information shall be the Customer's responsibility.

Any alteration, resizing, re-stitching, modification, or tailoring required because of Customer-provided information may be chargeable.

3.3 Failure to Provide Information

If the Customer fails to provide required measurements, approvals, documents, customization details, or other information within a reasonable period, the production or delivery timeline may be extended.

Any resulting delay shall not be treated as a breach by Fashion Femina Garments where the delay was caused by the Customer.

3.4 Customer Responsibility for Final Fit

The Customer acknowledges that garment fit may be affected by body shape, posture, fabric characteristics, construction, design, and other factors. Measurements supplied by the Customer are therefore an important component of the final result.


4. ORDER ACCEPTANCE

4.1 Order Placement

An order submitted by the Customer constitutes a request to purchase products from Fashion Femina Garments.

An order is considered accepted only when we have:

  • confirmed the order;

  • received the required payment; and/or

  • otherwise expressly confirmed acceptance in writing.

4.2 Right to Decline Orders

We reserve the right to decline, cancel, or refuse an order before acceptance where reasonably necessary, including where:

  • a product is unavailable;

  • required materials cannot be sourced;

  • information supplied is incomplete;

  • customization cannot reasonably be completed;

  • pricing or product information was materially incorrect;

  • payment cannot be verified;

  • fraud or suspicious activity is detected; or

  • circumstances outside our reasonable control prevent fulfillment.

Where applicable, any amount received for an order we decline before production may be dealt with in accordance with the applicable payment and refund provisions.

4.3 Order Confirmation

The Customer should carefully review the order confirmation, invoice, and customization details immediately after receipt.

Any apparent error should be brought to our attention promptly and before production begins.


5. PRICING AND PAYMENT

5.1 Prices

Prices displayed or quoted by Fashion Femina Garments are subject to the terms stated in the applicable quotation, invoice, or order confirmation.

Unless expressly stated otherwise, prices may exclude:

  • shipping charges;

  • customs duties;

  • import taxes;

  • local taxes;

  • alteration charges;

  • special customization charges; or

  • other third-party charges.

5.2 Payment Requirement

Unless otherwise agreed in writing, full payment or the applicable required advance payment must be received before production or order processing begins.

5.3 Payment Authorization

By submitting payment, the Customer represents that:

  • the payment method is lawfully available to the Customer;

  • the Customer is authorized to use the payment method; and

  • the transaction information supplied to us is accurate.

5.4 Failed or Reversed Payments

If a payment fails, is reversed, is returned, or is otherwise not successfully received by Fashion Femina Garments, we may suspend production or delivery until payment is successfully completed.

The Customer may also be responsible for reasonable bank, payment processor, or transaction-related charges arising from an unsuccessful or reversed payment, to the extent permitted by law.


6. NO CANCELLATION POLICY

6.1 Final Order Commitment

Because many of our products are custom-made, made-to-order, specially sourced, cut, embroidered, stitched, altered, or otherwise prepared specifically for the Customer, orders may not be cancelled once accepted and/or production or procurement has commenced.

6.2 No Cancellation for Personal Circumstances

Cancellation requests will generally not be accepted due to:

  • change of mind;

  • change in personal circumstances;

  • change in event date;

  • change in size;

  • change in color preference;

  • duplicate ordering;

  • inability to attend an event;

  • change of travel plans;

  • financial circumstances;

  • failure to review the order details;

  • failure to provide accurate measurements; or

  • any other Customer preference or circumstance.

6.3 Cancellation After Production Begins

Once fabric has been cut, materials have been purchased or allocated, embroidery or stitching has commenced, or other production work has begun, the order cannot ordinarily be cancelled or redirected.

6.4 Legal Rights

Nothing in this section is intended to exclude or restrict any right that cannot lawfully be excluded or restricted under applicable law.


7. NO RETURN AND NO EXCHANGE POLICY

7.1 Final Sale

Unless otherwise required by applicable law or expressly agreed by Fashion Femina Garments in writing, all purchases are final and are not eligible for return or exchange.

7.2 Scope

This policy applies to:

  • ready-to-wear garments;

  • made-to-order garments;

  • customized garments;

  • made-to-measure garments;

  • specially sourced products; and

  • garments produced according to Customer specifications.

7.3 Change of Mind

Returns or exchanges will not be accepted merely because the Customer:

  • changed their mind;

  • selected a different color;

  • selected a different size;

  • no longer requires the garment;

  • ordered the wrong product;

  • ordered the wrong size;

  • no longer likes the selected design; or

  • has otherwise changed their preference.

7.4 Custom Products

Because custom products are produced specifically for an individual Customer, Fashion Femina Garments may be unable to resell such products.

The Customer acknowledges this commercial reality when placing a custom or made-to-order order.

7.5 Statutory Rights

Nothing in these Terms removes any mandatory legal rights available to the Customer under applicable law.


8. DEFECTS, DAMAGE AND ORDER ERRORS

8.1 Genuine Manufacturing Issues

Where applicable law requires Fashion Femina Garments to provide a remedy for a genuine manufacturing defect or material failure to conform to the agreed order specifications, the Customer must notify us promptly after receiving the product.

8.2 Notice of Issue

Any notification should include:

  • order number;

  • Customer name;

  • description of the issue;

  • photographs or video clearly showing the issue;

  • photographs of the garment's relevant labels or identifying features; and

  • any other information reasonably requested by us.

8.3 Inspection

We reserve the right to inspect, investigate, or request additional photographs or information before determining whether an issue constitutes a manufacturing defect, shipping damage, Customer-caused issue, or reasonable variation.

8.4 Unauthorized Alterations

A garment that has been altered, washed, dyed, repaired, modified, resized, damaged, or otherwise treated by the Customer or a third party may not be eligible for a remedy for the resulting issue.


9. PRODUCTION TIME AND DELIVERY ESTIMATES

9.1 Estimates Only

Any production, dispatch, or delivery timeline communicated by Fashion Femina Garments is an estimate unless expressly guaranteed in writing.

9.2 Factors Affecting Production

Production may take longer due to:

  • customization requirements;

  • embroidery complexity;

  • fabric availability;

  • material sourcing;

  • artisan availability;

  • seasonal demand;

  • order volume;

  • quality-control requirements;

  • Customer approval delays;

  • measurement issues;

  • public holidays;

  • courier disruptions;

  • customs procedures;

  • weather events;

  • governmental restrictions; or

  • circumstances beyond our reasonable control.

9.3 Customer-Caused Delays

Where delay results from the Customer's failure to provide information, measurements, approvals, payments, or other required cooperation, the estimated timeline may be extended accordingly.

9.4 Delay Does Not Automatically Entitle Cancellation

A delay in an estimated production or delivery timeline does not automatically entitle the Customer to cancel an order, demand a discount, initiate a payment dispute, or claim damages, except where such rights are expressly required by applicable law.


10. SHIPPING AND DELIVERY

10.1 Shipping Providers

We may use third-party courier, logistics, postal, freight, or delivery providers.

Once an order is handed to the applicable carrier, portions of the delivery process may be outside our direct control.

10.2 Shipping Address

The Customer is solely responsible for providing an accurate and complete delivery address and contact information.

We are not responsible for delays, failed delivery, or additional charges resulting from an incorrect or incomplete address supplied by the Customer.

10.3 Tracking

Where tracking is available, we may provide tracking information to the Customer.

Tracking information supplied by a third-party carrier may be subject to the carrier's systems and updates.

10.4 Customs, Duties and Taxes

For international orders, the Customer may be responsible for customs duties, import taxes, brokerage charges, clearance fees, or other charges imposed by the destination country.

The Customer is responsible for understanding and complying with applicable import requirements.

10.5 Refused or Unclaimed Shipments

If a Customer refuses delivery, fails to collect a shipment, provides an incorrect address, or otherwise causes a shipment to be returned, the Customer may be responsible for applicable return shipping, storage, customs, reshipping, or other reasonable charges.


11. RISK, DELIVERY AND THIRD-PARTY SERVICES

Fashion Femina Garments is not responsible for delays, loss, damage, misrouting, customs detention, or other events caused solely by third-party shipping or logistics providers, except to the extent responsibility cannot lawfully be excluded.

Where appropriate, we may reasonably assist the Customer in communicating with the relevant carrier or initiating a carrier claim.


12. PAYMENT DISPUTES, CHARGEBACKS AND REVERSALS

12.1 Direct Communication

If the Customer believes there is an issue concerning an order or payment, the Customer agrees to contact Fashion Femina Garments first so that we have a reasonable opportunity to investigate and resolve the matter.

Customer-service contact does not prevent the Customer from exercising any non-waivable rights available under applicable law.

12.2 Accuracy of Payment Disputes

The Customer agrees not to knowingly submit false, misleading, fabricated, or inaccurate claims to a bank, card issuer, payment processor, marketplace, or other financial institution.

Examples include falsely claiming that:

  • an order was never placed;

  • a payment was unauthorized when it was authorized;

  • a product was never delivered when delivery occurred;

  • a product was defective when the Customer knows it was not;

  • a product was materially different from the agreed specifications when it was not; or

  • a refund was promised when no such promise was made.

12.3 Evidence

In the event of a payment dispute or chargeback, Fashion Femina Garments reserves the right to provide relevant records to the payment processor, bank, card issuer, marketplace, or other appropriate authority, including:

  • order records;

  • invoices;

  • payment records;

  • communications;

  • Customer approvals;

  • customization instructions;

  • measurement records;

  • production records;

  • photographs;

  • dispatch records;

  • tracking information; and

  • delivery confirmation.

12.4 Fraudulent or Misleading Claims

Where a Customer knowingly submits a false or fraudulent claim, Fashion Femina Garments reserves all rights and remedies available under applicable law, including the right to seek recovery of legitimate losses, transaction fees, costs, and other recoverable amounts.

12.5 No Waiver of Legitimate Legal Rights

Nothing in this section prevents a Customer from making a truthful payment dispute or exercising a mandatory legal right available to them.


13. CUSTOMER COOPERATION

The Customer agrees to reasonably cooperate with Fashion Femina Garments in connection with an order, including by:

  • providing accurate information;

  • responding to reasonable requests;

  • reviewing customization details;

  • providing measurements;

  • approving designs where required;

  • making payments on time;

  • providing a valid delivery address; and

  • cooperating with reasonable shipping or customs procedures.

Failure to cooperate may result in additional costs or delays.


14. FORCE MAJEURE

Fashion Femina Garments shall not be liable for failure or delay in performing its obligations to the extent caused by circumstances beyond our reasonable control.

Such circumstances may include:

  • natural disasters;

  • floods;

  • earthquakes;

  • fire;

  • epidemic or pandemic;

  • war;

  • terrorism;

  • civil unrest;

  • strikes;

  • governmental restrictions;

  • changes in law;

  • transportation disruptions;

  • courier disruptions;

  • customs restrictions;

  • supplier failures;

  • shortages of materials;

  • utility failures;

  • internet or telecommunications failures;

  • power outages;

  • labor shortages; or

  • other events beyond our reasonable control.

Where such circumstances occur, we may reasonably extend production or delivery timelines or take other commercially reasonable steps to complete the order.


15. INTELLECTUAL PROPERTY

15.1 Ownership

All intellectual property associated with Fashion Femina Garments, including:

  • logos;

  • trademarks;

  • brand names;

  • product photographs;

  • videos;

  • graphics;

  • designs;

  • patterns;

  • written descriptions;

  • website content;

  • marketing materials;

  • original artwork;

  • product concepts; and

  • other proprietary materials

is owned by or licensed to Fashion Femina Garments and is protected by applicable intellectual-property laws.

15.2 Restrictions

The Customer may not, without prior written permission:

  • reproduce our designs;

  • copy our product photographs;

  • reproduce our written content;

  • use our branding;

  • commercially exploit our designs;

  • modify and redistribute our materials; or

  • represent our intellectual property as their own.


16. CUSTOMER-PROVIDED CONTENT AND DESIGNS

Where the Customer supplies photographs, artwork, designs, measurements, logos, references, or other materials for customization, the Customer represents that they have the necessary rights and permissions to provide those materials to us.

The Customer shall not knowingly provide materials that infringe another person's intellectual-property rights or violate applicable law.

The Customer remains responsible for any claims arising from materials supplied by the Customer.


17. PHOTOGRAPHS OF COMPLETED PRODUCTS

Unless otherwise agreed in writing, Fashion Femina Garments may photograph or record completed garments for internal quality-control, record-keeping, portfolio, marketing, advertising, or social-media purposes.

Where the garment contains identifiable Customer information or the Customer's recognizable likeness, we will handle such information in accordance with our applicable privacy practices and any consent requirements imposed by law.


18. PRIVACY AND PERSONAL INFORMATION

We may collect and process information necessary to:

  • process orders;

  • manufacture customized garments;

  • communicate with Customers;

  • arrange shipping;

  • process payments;

  • provide customer support;

  • prevent fraud;

  • maintain business records; and

  • comply with legal obligations.

Such information may include name, contact details, delivery address, measurements, customization information, and transaction information.

Personal information will be handled in accordance with our applicable Privacy Policy and applicable data-protection laws.


19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Fashion Femina Garments shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from an order, including losses relating to:

  • inconvenience;

  • loss of opportunity;

  • loss of anticipated profits;

  • loss of an event opportunity;

  • travel arrangements;

  • event cancellation;

  • personal circumstances; or

  • other consequential losses.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited under applicable law.


20. NO GUARANTEE OF PARTICULAR RESULTS

Fashion Femina Garments does not guarantee that a garment will:

  • appear identical to a reference photograph;

  • fit identically to another garment;

  • meet an individual's subjective expectations;

  • be suitable for a particular event or occasion; or

  • produce a particular aesthetic result beyond the agreed product specifications.

Subjective dissatisfaction, preference changes, or expectations that were not part of the agreed specifications do not automatically constitute a defect.


21. CUSTOMER'S RESPONSIBILITY FOR USE AND CARE

The Customer is responsible for following any care instructions supplied with the garment.

Damage resulting from improper:

  • washing;

  • drying;

  • ironing;

  • bleaching;

  • dry cleaning;

  • storage;

  • handling;

  • alteration; or

  • other care

may not be attributable to Fashion Femina Garments.


22. FRAUD PREVENTION

Fashion Femina Garments reserves the right to take reasonable steps to prevent fraud and protect our business and Customers.

We may, where appropriate and legally permitted:

  • request additional order verification;

  • request confirmation of billing or shipping information;

  • delay processing while verification is completed;

  • decline suspicious transactions;

  • cancel an order before production where fraud is reasonably suspected; and

  • cooperate with payment processors, banks, courier companies, or law-enforcement authorities where legally required or appropriate.


23. ACCOUNT SUSPENSION AND REFUSAL OF FUTURE ORDERS

Where reasonably necessary and permitted by law, Fashion Femina Garments may refuse future orders or restrict access to its services where a Customer:

  • repeatedly submits false claims;

  • engages in abusive conduct;

  • attempts payment fraud;

  • misuses payment-dispute procedures;

  • provides materially false information;

  • engages in harassment or threatening behavior;

  • attempts to circumvent these Terms; or

  • otherwise creates a material risk to our business.

This does not affect any legitimate rights the Customer may have under applicable law.


24. CUSTOMER COMMUNICATIONS

The Customer agrees that order-related communications may be sent through the contact information supplied at the time of purchase, including:

  • email;

  • telephone;

  • SMS;

  • WhatsApp;

  • social-media messaging; or

  • other communication channels used by Fashion Femina Garments.

The Customer is responsible for ensuring that their contact information remains accurate and accessible.


25. THIRD-PARTY LINKS AND SERVICES

Our website or communications may contain links or references to third-party services, including:

  • payment processors;

  • courier services;

  • social-media platforms;

  • marketplaces; and

  • other external service providers.

We are not responsible for the policies, practices, availability, or content of third-party services.

Use of such services may be subject to separate terms imposed by the relevant third party.


26. MODIFICATION OF PRODUCTS AND SERVICES

Fashion Femina Garments reserves the right to modify, discontinue, replace, or update products, designs, materials, pricing, website content, or services from time to time.

For an order already accepted, we will make commercially reasonable efforts to fulfill the agreed specifications, subject to these Terms and circumstances beyond our reasonable control.


27. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The latest version published on our website will apply to future orders unless a different version is expressly incorporated into an existing written agreement.

The version applicable to an existing order will generally be the version accepted by the Customer at the time the order was placed, subject to mandatory changes required by applicable law.


28. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable by a competent authority, that provision shall be modified or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect to the extent permitted by law.


29. NO WAIVER

Failure by Fashion Femina Garments to enforce any provision of these Terms on one occasion does not constitute a waiver of our right to enforce the same provision on a later occasion.


30. ENTIRE AGREEMENT

These Terms, together with the applicable invoice, quotation, order confirmation, customization approval, measurement record, and other expressly incorporated written terms, constitute the agreement governing the relevant purchase.

In the event of an apparent conflict, the documents shall be interpreted, to the extent legally permissible, in a manner that gives effect to all provisions. The specific written order confirmation may control with respect to product-specific specifications.


31. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of [Insert State/Country], without regard to conflict-of-law principles, except to the extent mandatory law provides otherwise.


32. JURISDICTION AND DISPUTE RESOLUTION

The parties will make reasonable efforts to resolve any genuine dispute through direct communication before commencing formal proceedings.

If a dispute cannot be resolved amicably, it shall be subject to the dispute-resolution process and jurisdiction specified below, subject always to any mandatory rights available to the Customer under applicable law.

33. CUSTOMER ACKNOWLEDGMENT

  3. They understand that customized and made-to-order products may contain reasonable variations.

  4. They are responsible for the accuracy of measurements and other information supplied by them.

  5. They understand that accepted custom and made-to-order orders generally cannot be cancelled.

  6. They understand that purchases are generally final and not eligible for return or exchange, subject to applicable law.

  7. They understand that production and delivery timelines may be estimates.

  8. They agree to provide accurate payment, contact, and delivery information.

  9. They agree not to knowingly submit false or misleading payment disputes or claims.

  10. They understand that legitimate statutory or legal rights are not excluded by these Terms.

  11. They agree to cooperate reasonably with Fashion Femina Garments in resolving genuine order-related issues.

  12. They agree that these Terms form part of the agreement governing their purchase.


 

WEBSITE CHECKOUT ACKNOWLEDGMENT

Where these Terms are presented during checkout, the Customer may be required to actively confirm:

By completing the purchase after providing such acknowledgment, the Customer confirms acceptance of the applicable Terms, subject to rights that cannot legally be excluded.
